‘Medical staff professional liability’ insurance can be taken out by every person who has gained medical education and qualifications- doctor, chemist, dentist, healthcare specialist(nurse, midwife, medical auxiliary, laboratory assistant, rehabilitation therapist).

Who is obliged to take out the insurance?

Healthcare institutions are obliged to insure their medical staff against the damages that can occur as a result of failure to fulfill their professional obligations. The scope of the insurance coverage includes all the medical staff except the administrative staff (accountants, lawyers and others), drivers, hospital attendants and others who are not in the medical profession. The healthcare institution which takes out the insurance and specifies the conditions to it acts in the capacity of insurer according to the policy.

What is the insurance protection provided by the insurance?

The insurance covers indemnity claims for bodily harm or the death of a patient as a result of negligence, mistake or oversight in the course of receiving professional assistance from doctors and medical staff.

The insurer considers and indemnifies the claims which have been laid against the insured for the first time in writing during the term of operation of the insurance on condition that the events on the ground of which the claims have been laid have taken place after the initial date of the insurance.

The insurance coverage can be extended through taking out the ‘retroactive activity’ coverage. A retroactive date is negotiated on the policy, one which precedes the initial date of the insurance with one year for example. On the basis of this the insurer considers and indemnifies claims which have been laid during the term of operation of the insurance but are based on events which have taken place after the retroactive date written in the policy.
